Welcome to Pierce Burkkina. These Terms & Conditions (“Terms”) are an agreement between you and Pierce Burkkina LLC (“Pierce Burkkina,” “we,” “our,” or “us”). They govern your use of pierceburkkina.com (the “Site”) and any purchase you make on it.
By using the Site or placing an order, you agree to these Terms. Our Privacy Policy and our Delivery & Returns Policy are part of these Terms. If you do not agree, please do not use the Site.
Eligibility & Accounts
- You must be at least 18 years old to place an order, or use the Site with the involvement of a parent or legal guardian.
- If you create an account, keep your password confidential. You are responsible for activity under your account.
- Tell us right away if you think your account has been used without your permission.
Product Information & Availability
- We try to describe and photograph our products accurately. Colors may look different on different screens, and fabric, wash, and finish can vary slightly from piece to piece.
- Size and fit guidance is a recommendation, not a guarantee.
- Product availability is not guaranteed. We may discontinue products or limit quantities per order.
Pricing, Taxes & Shipping Charges
- All prices are listed in U.S. Dollars (USD).
- Shipping is charged on every order and is paid by the customer. Shipping is not included in product prices. The shipping cost is shown at checkout before you pay.
- Sales tax is added at checkout where required by law.
- International customers pay any import duties, taxes, and customs fees.
- Prices and promotions may change at any time. A change will not affect an order we have already confirmed.
- If a product is listed at an obviously incorrect price because of an error, we may cancel the order. If we do, we will notify you and refund you in full. We will never charge more than the price shown at checkout without your agreement.
Orders & Payment
- When you place an order, you make an offer to buy. We accept it when we send your shipping confirmation.
- We may refuse or cancel an order for reasons such as suspected fraud, errors, or a product being unavailable. If you have already been charged, we will refund you in full.
- Payments are securely processed by third-party providers (Stripe, Klarna, and Affirm). We do not store full payment card numbers.
- If you pay with Klarna or Affirm, your financing agreement is with that provider and its own terms apply.
Shipping, Title & Risk of Loss
Processing and delivery times are explained in our Delivery & Returns Policy. Ownership of the products, and the risk of loss, pass to you when the carrier delivers them to the shipping address you provided. If your package is lost or damaged in transit, contact us and we will help with a carrier claim, a replacement, or a refund, as described in that policy.
Returns, Exchanges & Refunds
Returns are handled under our Delivery & Returns Policy. In summary:
- Eligible items may be returned within 14 days of delivery. They must be unworn, unwashed, and unaltered, with all tags attached.
- The customer pays return shipping, unless the item arrived damaged or defective, or we sent the wrong item.
- Original shipping charges are non-refundable.
- Items discounted 50% or more are Final Sale.
Product Warranty
If an item arrives damaged or defective, or isn’t what you ordered, contact us within 14 days of delivery. We will repair, replace, or refund it, at our choice, and pay for return shipping. Normal wear, damage from not following the care instructions, alterations, and accidents are not defects.
Any warranties that California or other applicable law gives you, including implied warranties, are limited only as far as the law allows. Nothing in these Terms limits your rights as a consumer.
Use of This Website
You agree to use this Site only for lawful purposes. You must not:
- Use the Site for fraudulent or unlawful activity
- Attempt to interfere with Site security or operation
- Introduce malicious software or harmful code
- Scrape the Site or copy, reproduce, or exploit its content without written permission
- Resell products purchased on the Site commercially without our written permission
We may suspend or end your access to the Site if you violate these Terms.
Intellectual Property
All content on this Site belongs to Pierce Burkkina or its licensors and is protected by U.S. and international intellectual property laws. This includes logos, product designs, graphics, images, text, branding, and layout. You may view the Site and print pages for personal, non-commercial use. Any other use requires our prior written permission.
User Submissions
If you submit reviews, comments, images, or other content:
- You confirm that it is yours, that it is accurate, and that it does not violate anyone else’s rights.
- You grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce it, with or without your name, in connection with our business.
- We may remove content at our discretion. We do not edit reviews in a way that changes their meaning.
Promotions & Discount Codes
Discount codes, including the 10% first-order email offer, are limited to one per customer and one per order. They cannot be combined unless stated, have no cash value, and cannot be applied to past orders. We may end or change promotions at any time. If you return an item bought with a discount, your refund is the amount you actually paid.
Third-Party Links
Our Site may link to third-party websites and services, such as payment, financing, and social media. We do not control them and are not responsible for their content, policies, or practices.
Limitation of Liability
To the fullest extent permitted by law, Pierce Burkkina is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
This section does not limit liability that cannot be limited by law. This includes liability for gross negligence, fraud, willful misconduct, or personal injury caused by our negligence, and your rights under California consumer protection laws.
Disclaimer
Except as stated in the Product Warranty section, and to the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.”
Indemnification
If you misuse the Site or knowingly violate these Terms, you agree to cover reasonable losses and costs, including reasonable legal fees, that we incur from resulting third-party claims. This does not apply where prohibited by law.
Governing Law & Disputes
These Terms are governed by the laws of the State of California, regardless of conflict-of-law rules. If you have a concern, please contact us first at hello@pierceburkkina.com so we can try to resolve it informally.
If a dispute is not resolved informally, it will be decided in the state or federal courts located in Los Angeles County, California, unless the law gives you the right to bring it elsewhere. You may also bring an individual claim in small claims court if it qualifies.
Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised “Last Updated” date. The Terms in effect when you place an order apply to that order.
General
If any part of these Terms is found unenforceable, the rest remains in effect. If we don’t enforce a provision, that does not waive it. These Terms, together with our Privacy Policy and our Delivery & Returns Policy, are the entire agreement between you and us about the Site.
